Terms of Use

1. Scope

These Terms of Use govern the use of the online customer portal ("Portal") of Fundamental Energy GmbH, Max-Urich-Straße 3, 13355 Berlin ("we", "us"), through which registered customers can view their consumption data and contract structure.

The Portal is a free additional service provided alongside the existing energy supply contract. The terms of the energy supply contract remain unaffected by these Terms of Use and prevail in case of doubt.

2. Scope of Services

The Portal provides read-only access to:

• consumption data (e.g. load profiles, meter readings, annual consumption)
• an overview of the contract structure (e.g. delivery points, metering points, contract data)

The Portal cannot be used to amend contracts, change tariffs, make payments, or submit any other legally binding declarations.

3. Registration and Access Data

Access is provided via personal access credentials, which must be treated confidentially.

Users are obliged to inform us without undue delay if there is any suspicion that access credentials have become known to third parties.

We reserve the right to temporarily block access in the event of suspected misuse.

4. Availability and Liability

We endeavor to keep the Portal available as continuously as possible, but we do not guarantee uninterrupted availability (e.g. during maintenance work or technical disruptions).

The consumption data displayed in the Portal is provided for information purposes only. Only the information on the invoice or the values recorded by the metering point operator are legally binding.

We are liable for indirect damages and lost profits only in cases of intent or gross negligence. Liability for damages resulting from injury to life, body, or health remains unaffected.

5. Use of the Portal

Users undertake not to misuse the Portal, in particular not to:

• carry out automated queries (e.g. scraping) without our consent,
• circumvent or manipulate security mechanisms.

6. Termination of Portal Access

Users may request deletion of their Portal access informally at any time.

We may discontinue or change access to the Portal with reasonable prior notice, provided this does not impair any material contractual rights under the energy supply contract.

Termination of Portal access does not affect the continued existence of the energy supply contract.

7. Data Protection

8. Changes to These Terms of Use

We may amend these Terms of Use with effect for the future if this is necessary to adapt them to changed legal or technical conditions. We will inform users of material changes by email or by notice in the Portal.

9. Final Provisions

German law applies.

If any provision of these Terms of Use is invalid, the validity of the remaining provisions remains unaffected.
